Jaywalking Mother May Spend More Time in Jail than Hit-and-Run Drunk Driver who Killed her 4-Year-Old Son

An Atlanta-area mother who illegally crossed a street with her three children may spend more time in jail than the repeat offender hit-and-run drunk driver who struck and killed her four-year-old son.

According to the Atlanta Journal-Constitution, 30-year-old Raquel Nelson was attempting to cross at the intersection of Austell Road and Austell Circle in Marietta when Jerry Guy, who confessed to having drank “a little” alcohol earlier in the day, struck and killed her four-year-old son. Guy, who is partially blind in one eye and also on pain medication, fled the scene.

The child later died of his injuries. Nelson and her young daughter were slightly injured.

Guy, who has two previous hit-and-run convictions, was charged with hit-and-run, first degree homicide by vehicle and cruelty to children. But the charges were later reduced down to just hit-and-run. He served six months and was released in October.

For her role in her son’s death, Nelson has been charged with second degree vehicular homicide, crossing a roadway elsewhere than at a crosswalk and reckless conduct. She could face up to three years behind bars. Her sentencing hearing is scheduled for July 26.

      Hal you are clearly not an intelligent human being, and seem to hold some arrogant and ignorant views toward everyone in a nation. You do not display any evidence of the claims you made, and appear to be a what i would call a human garbage. Get off your high horse you uneducated hippie the world is clearly a more complex place then you can grasp, and that is ok being stupid does not give you the right to bash the United States. People like you create social strife and destroy the complex relationships between people of different background. Go back to working your deadbeat job and abusing substances, the mother had full blame for what happened to her child because she acted reckless and did not use her brain.

          i do not believe that i used any vulgar words, maybe reading the whole paragraph is difficult for you. Maybe i can reward my previous statement, and explain my views a bit further. i dislike people who play the race card, it has been scientifically proven that everyone on this planet is genetically identical. The mother made a stupid decision regardless of her ethical background or religion. May i ask who in their right mind jaywalks with their very young kids. Would you jaywalk with a four year old at your side? Most individuals with an IQ above 70 would not. it is funny how “HAL” claims that we live under some sort of totaliterian nazi regime, when the facts of our social existence point otherwise. The woman failed to use her brain and made a reckless decision, and ended up paying for it. It is that simple she should receive some punishment for her involvement in her child’s death. I feel that the driver does deserve a harsher punishment, but we cannot simple view the mother as an angel, and not hold her responsible for her stupid decision. It is illogical to throw blame at a nation and claim that one of the most progressive nations in the world runs like a nazi regime. Ignorance and lack of knowledge cause so many social problems please think about my statments.

            Much better. I always prefer a well-stated, respectful debate to insult-slinging. I agree with you that the mom made a stupid decision and should face sanction for her poor parenting. As for Hal’s comment, it is indeed very much over the top with its “worse than Hitler” accusation. However, I suspect Hal was merely reacting to the post and made his/her assertion in the heat of the moment. That being said, I must disagree with your assertion that the US is “one of the most progressive nations in the world.” It is a corporatist, imperialist and somewhat racist state defined above all by hypocrisy. The “inalienable rights” of “we the people” do not include homosexuals (who are denied marriage equality in almost every state and who are committing a felony in Montana by sleeping with members of the same sex), Muslims (who face daily discrimination), blacks (who face widespread economic and cultural discrimination), Native Americans (genocide victims who continue to face Third World living conditions), atheists and other freethinkers (who are bombarded by an ever-encroaching ‘American Theocracy’), undocumented immigrants, and others. There is no true political freedom of choice in the U.S.; third-party candidates are marginalized and have no chance of success at the national level and the “Republicrats” have a stranglehold over our political system, aided by a corporatist and corrupted Supreme Court. I can go on for hours…

    this is so sick how can they give her more time she lost her child to a mindless repeat drunk that got behind the wheel knowing full well he should not be driving and he gets a few months for taking the life a child an white people think things have gotten better this is so sick

    I just watched this on the morning news, having lost my own child to a hit and run driver who was only charged with leaving the scene of an accident and spend less than a year in jail, it really hits home with me, this mother, who is trying to do the best for her children, living in an environment where she fears for them and having no choice, I wish someone would step forward and give her a home in a safe place, and a car, so she can at least raised her remaining children in some small amount of peace. If she goes to jail it will be one of the worst travesties of justice I have ever seen.
